Let's Start with which Court Rules on Child Support?

Until recently, both the Rabbinical Court and the Family Court could rule on child support, depending on who filed first. But that’s no longer the case.

New Legal Update - As of February 19, 2o25, Only the Family Court can rule on child support matters, making it that the Rabbinical Court no longer has jurisdiction, and that is, even if a spouse files there first. The only way that the Rabbinical court can rule on these matters, is if both parents agree it. (Ruling - 5899/21)

This is a major shift that ensures child support is calculated fairly under civil law, bringing more consistency to financial rulings.

So Ultimately, how Is Child Support Calculated?

First things fist - when it comes to child support - always remember this :It’s About the Child—Not the Parents – Child support is based on the child’s actual expenses, including housing, food, education, and healthcare. The mother’s financial situation does not determine what the father must pay.

Higher Support for Kids Under 6 – Fathers of young children are required to cover nearly all essential expenses, meaning support payments are much higher for children under 6.

What If Custody Is 50/50? – If both parents have exactly equal custody and similar incomes, the father may be exempt from paying child support. But if one parent earns significantly more, they may still have to contribute.
